Havi’s Take On Reggae COMPLETELY Being Stopped, BBI Bill Dead
The BBI Bill has today Thursday been declared unconstitutional by the supreme court led by a seven-bench judge at the High Court of Kenya.
Speaking right after the ruling, Law Society of Kenya President Nelson Havi says the BBI initiative has fallen since it was not a people-driven initiative but rather an enterprise by President Uhuru Kenyatta and his brother Hon. Raila Odinga. Secondly, there was no adequate public participation in the process of the initiation and promotion of the BBI Bill.
Havi says it is a landmark decision that will go a long way in shaping the democratic space in Kenya today henceforth.
He adds “President Uhuru Kenyatta has always taken the constitution of Kenyans as an inconvenience in his administration. Had they done the right thing, purposed to amend the constitution, they ought to have pursued this process through parliament… and if it was a concerted process by Uhuru and Raila, they had the control of parliament and could have done it…But they decided to take the role of the people and that is wrong”
Havi explains that there is nothing wrong with amending the constitution or dismembering it, only that if you have to amend it, you have to follow the procedure.
If you have to dismember, then you are for all practical purposes creating a new constitution. You follow the four sequential steps enumerated and which are historically and lawfully a prerequisite to the making of a new constitution.
Political Influence
“Four years have been wasted as the big four agenda has not been achieved and everybody is poor. Everybody is in Fuliza mode because Uhuru was sidetracked from the performance of his duties.” Havi says
Uhuru let the parliament be emasculated, purchased the opposition with the hope that there will be peace and tranquility but there has been no development.
He concludes that going forward it is imperative for the Kazi ni Kazi Initiative “preachers” to continue messaging that what is important right now is not the amendment of the constitution to make provisions for a few individuals but the implementation of the constitution to make sure there is economic and social development from bottom up.
This will help everybody to have money in his or her pockets so that we get rid of the shylocks, Fuliza, and credit reference bureaus that have encumbered social-economic development.
